Hawaii Brain Injury- Current News & Articles
Ms. Williamson was fatally injured when her family's 1993 minivan was struck head-on because her rear center seat was equipped with a lap-type seat belt, rather than the safer lap/shoulder type. After numerous appellate decisions, the family's product liability action against Mazda has finally been upheld in the U.S. Supreme Court against challeges that state law products liability claims were an "obstacle" to federal minimum safety standards and preempted by federal law regulating auto safety which only required a lap belt in a middle rear seat. This important decision reaffirms that each state has a certain level of autonomy in regulating the safety of its marketplace. Williamson v. Mazda Motor of America, Inc., U.S. Sup. Ct. Case No. 08–1314 (February 23, 2011) reversing 167 Cal. App. 4th 905, 84 Cal. Rptr. 3d 545 (2008).
